Operating vehicle with One Headlight lands 2 behind bars in Clay County on serious charges

MANCHESTER, KY - Clay County Sheriff Patrick Robinson is reporting that on March 30, 2019 at approximately 1:30 AM Clay County Sheriff Deputy Brandon Edwards arrested two individuals after observing a vehicle operating with one headlight.

Arrested was:

Dustin Burkhart, 21 and Tommy Asher, 21 both of Huff School Road.

The arrest occurred when Deputy Edwards observed a white four door vehicle operating with one headlight on White Street.

Deputy Edwards conducted a traffic stop on the vehicle and when contact was made with the driver he showed obvious signs of impairment. Standardized field sobriety tests were conducted in which through totality of circumstances the subject was under the influence.

Once the driver was placed under arrest, Deputy Edwards located on the person a plastic baggy which contained a green leafy substance.

Contact was made with the passenger and he showed signs of impairment also. Through further search of the vehicle, Deputy Edwards located more green leafy substance suspected to be Marijuana, a glass pipe loaded with the green leafy substance and open containers of Alcoholic beverages.

The driver was transported to Advent Health Manchester where he refused to submit a blood test. 

Dustin Burkhart was charged with:

  • One Headlight
  • Operating Motor Vehicle under the influence of ALC/DRUGS/ETC. .08
  • Possession of Marijuana
  • Possession of open Alcohol Beverage Container in Motor Vehicle
  • Tommy Asher was charged with:

  • Public Intoxication of Controlled Substance (Excludes Alcohol)
  • Possession of Marijuana
  • Drug Paraphernalia Buy/Possess
  • Possession of open Alcohol Beverage Container in Motor vehicle
