Maysville Habitual Offender Charged with Reckless Homicide after Hitting Flagman in Lewis County, Kentucky

TOLLESBORO, KY – The Kentucky State Police (KSP) is reporting that on September 29, 2022, KSP Post 8, Morehead, received a call for assistance with a single vehicle fatal collision in Lewis County.

The collision occurred on KY 57 at approximately 8:40 A.M.. Through the investigation, Troopers determined Allen D. Congleton (25) from Mt. Sterling, KY was directing traffic while road construction was in progress.

Allen Congleton was struck by a Chevy pick-up truck being operated by Joshua T. Henderson (26) from Maysville, KY.

Mr. Congleton was transported to Meadowview Regional Medical Center in Maysville where he was pronounced deceased

Joshua Henderson was arrested and charged with:

  • Reckless Homicide
  • Leaving the Scene of Accident
  • Failure to Render Aid/Assist with Death or Serious Injury
  • Driving DUI Suspended 2nd (Aggravated)
  • Tampering with Physical Evidence

This individual was lodged in the Greenup County Detention Center.

  • Tollesboro Fire Department

This collision remains under investigation by Kentucky State Police Post 8, Morehead.

In the past, Mr. Henderson has faced numerous charges, including but not limited to:

  • DUI (multiple)
  • Public Intoxication
  • Driving on a DUI Suspended License (multiple)
  • Speeding 26 MPH or greater
  • Failure to update personal address
  • Libel and Slander (Courtroom)
  • A variety of motor vehicle related violations

On January 26, 2018, Joshua T. Henderson (22 at that time) was arrested in the Mason District Court in Maysville, KY. 

Joshua Henderson was charged with the following:

  • Failure of Owner to Maintain Required Insurance/SEC-1st offense
  • Failure to Register Transfer of Motor Vehicle
  • No Registration Plates
  • Operating on Suspended or Revoked Operator's License
  • Operating Motor Vehicle Under the Influence Alcohol/Drugs/ETC. .08- 1st offense

Since that time Mr. Henderson has been arrested on multiple occasions including:

  • July 4, 2018 - Maysville Police
  • July 24, 2018 - Maysville Police
  • October 30, 2018 - Maysville Police
  • October 27, 2019 - Bracken County Sheriff's Office
  • August 22, 2020 - Mason County Sheriff's Office
  • February 20, 2021 - Flemingsburg Police
  • May 4, 2021 - Lewis County Sheriff's Office
  • October 22, 2021 - Lewis District Court
  • July 19, 2022 - Mason County Sheriff's Office
