Attorney General Cameron Protects Kentucky Coal in Procedural Win Against EPA

FRANKFORT, KY (June 1, 2023) – The Sixth Circuit yesterday granted an administrative stay of the Biden Administration's disapproval of Kentucky's state implementation plan under the Clean Air Act. This interim ruling limits the Environmental Protection Agency's ability to dictate how Kentucky meets air quality standards within its own borders.

If successful, the EPA's reckless regulation would wreak havoc in the Commonwealth, forcing the shutdown of many of Kentucky's coal-fired power plants—killing jobs and raising utility rates for Kentuckians.

Following the ruling, Attorney General Cameron released this statement:

"I have fought the Biden Administration's heavy-handed approach to environmental regulation every step of the way. Today's ruling is an important win for Kentucky's ability to decide for itself how best to meet air quality standards. President Biden doesn't care if his radical agenda undermines our economy or increases utility bills for hard-working Kentuckians, but I do, and I'm pleased that the Sixth Circuit gave Kentuckians this relief. We will continue to press our case to the Sixth Circuit."
