Seven week old baby found unresponsive - Father arrested in Laurel Co.



Laurel County, KY - Sheriff John Root is reporting that: Detective Kyle Gray along with Detective Kevin Berry arrested Gary nicely age 34 of Old Whitley Rd., London on Tuesday afternoon August 30, 2016 at approximately 3:10 PM.

The arrest occurred at St. Joseph Hospital London after deputies were dispatched to a complaint received from the hospital that a seven week old female baby had sustained severe injuries and was being transported to UK Hospital Lexington for further treatment.

Sheriff's detectives conducted an investigation and learned that the baby had a severe head injury, and the biological father, who was caring for the child at their home on Philpot Road approximately 3 miles south of London, had no explanation as to the cause of the injury.

The biological mother had taken a seven-year-old child to school early Tuesday morning and returned home to find the baby unresponsive. Two other children were present in the home – a four-year-old and another seven week old baby. The baby is at UK med center in critical condition.

Gary Nicely was charged with assault – first-degree – domestic violence; wanton endangerment – first-degree; resisting arrest; disorderly conduct – second degree; and menacing. When arrested this subject became very irate at the hospital clinching both fists and failed to comply with investigating/arresting sheriff's detectives, and after a brief struggle was taken into custody.

Assisting on the investigation was: Lieut. Greg Poynter and Sgt. Brett Reeves.

Gary Nicely was lodged in the Laurel County Detention Center.
