Laurel County, KY - Sheriff John Root is reporting that: Jessica Nicely age 31 has been charged with one count of murder and two counts of criminal abuse – first-degree – child 12 or under.
Her husband, Gary Nicely age 34 has been charged with one count of murder and one count of criminal abuse – first-degree – child 12 or under.
These two individuals continue to be lodged in the Laurel County Detention Center.
This investigation is continuing by Detective Kyle Gray and Detective Kevin Berry.

Update on 9-2-2016 at 9:15 A.M.
Laurel County, KY - Sheriff John Root is reporting that: the 7 week old baby was pronounced deceased on Thursday evening 9-1-2016 at approx. 6:43 P.M. An autopsy is being conducted in Frankfort on Friday.
Her twin remains hospitalized at UK Children's Hospital. Additional charges are expected as the investigation continues.
Detective Kyle Gray and Detective Kevin Berry continue the investigation.

Detective Kyle Gray along with Detective Kevin Berry arrested Jessica H. Nicely age 31 of Philpot Road, London on Thursday afternoon Sept. 1st, 2016 at approximately 2:50 PM.
The arrest occurred in London after detectives conducted a thorough investigation regarding a complaint that a seven week old female baby had sustained severe injuries and had been brought to a local hospital and was being transported to UK Hospital Lexington for further treatment on 8/30/2016.
Later that day, sheriff's detectives arrested her father Gary Nicely charging him with assault – first-degree – domestic violence; wanton endangerment – first-degree; resisting arrest; disorderly conduct – second degree; and menacing. The baby was determined to have critical head trauma. Her twin was also transported to UK Children's Hospital and was found to have injuries, too.
As a result of the continuing investigation, Sheriff's detectives charged the biological mother – Jessica Nicely with two counts of assault – first-degree – domestic violence and two counts of wanton endangerment – first-degree.
The assault first-degree charges relate directly to both seven week old babies and the wanton endangerment charges relate directly to the four-year-old female infant and the seven-year-old female child.
Jessica Nicely was lodged in the Laurel County Detention Center.

More charges are expected as the investigation continues.
