IRS issues final ACA Employer Mandate Rule: The Internal Revenue Service (IRS) has released the final rule implementing the employer shared responsibility provisions of the Affordable Care Act (ACA). Highlights are below:

  • The mandate will generally apply to larger firms with 100 or more full-time employees starting in 2015 and employers with 50 or more full-time employees starting in 2016.
  • The mandate will not apply until 2016 to employers with at least 50 but fewer than 100 full-time employees, providing the employer completes certain certification requirements.
  • To avoid a payment for failing to offer health coverage, employers need to offer coverage to 70 percent of their full-time employees in 2015 and 95 percent in 2016 and beyond.

New IRS rule impacts all holders of federal EINs: Effective January 1, 2014, a new IRS rule obligates all entities that have EINs to report to the IRS any changes in the "responsible party" with respect to that EIN. Beginning January 1, 2014, any changes to the identity of an entity must be reported to the IRS using Form 8822-B, within 60 days of the change occurring. To access the form click here

Disability self-identification form for federal contractors: The Office of Federal Contract Compliance Programs has released the revised self-identification form that government contractors are expected to use to comply with the new affirmative action regulations issued on September 24, 2013 for individuals with disabilities. The new regulations, effective March 24, 2014, require contractors to solicit disability information from applicants at the pre-offer stage and from new hires at the post-offer stage. Within the first year of the regulations' effective date and at least every five years thereafter, contractors are also required to ask their employees to self-identify their disability status.
